Privacy Policy

What I collect, why, and what you can ask me to do about it. The policy is formal, because it has to be. The notes in the margin are me, leaning over to explain; the policy is what applies.

Last updated

This Privacy Policy sets out my commitment to protecting the privacy of personal information provided to me, or otherwise collected by me, offline or online, including through my website (Site).

In short

In shortOne document for everything I collect, online and off. There is only one of me, so every "I" in here is the same person, sitting at the same desk in Hobart.

Personal Information

The types of personal information I may collect about you include:

  • Your name;
  • Your contact details, including email address, mailing address, street address and/or telephone number;
  • Your demographic information, such as postcode;
  • Your preferences and/or opinions;
  • Your likeness represented in the form of recorded video, audio or other such rendering;
  • Information you provide to me through customer surveys;
  • Your browser session and geo-location data, device and network information, statistics on page views and sessions, acquisition sources, search queries and/or browsing behaviour;
  • Information about your access and use of my Site, including through the use of Internet cookies, your communications with my Site, the type of browser you are using, the type of operating system you are using and the domain name of your Internet service provider;
  • Additional personal information that you provide to me, directly or indirectly, through your use of my Site, associated applications, associated social media platforms and/or accounts from which you permit me to collect information; and
  • Any other personal information requested by me and/or provided by you or a third party.

I may collect these types of personal information directly from you or from third parties.

In short

In shortMostly what you choose to tell me, plus what every website quietly notices, such as your browser and roughly where you are. I will not judge your browser. Out loud.

Collection and use of personal information

I may collect, hold, use and disclose personal information for the following purposes:

  • To enable you to access and use my Site, associated applications and associated social media platforms;
  • To contact and communicate with you;
  • For internal record keeping and administrative purposes;
  • For analytics, market research and business development, including to operate and improve my Site, associated applications and associated social media platforms;
  • To run competitions and/or offer additional benefits to you;
  • For advertising and marketing, including to send you promotional information about my products and services and information about third parties that I consider may be of interest to you, and;
  • To comply with my legal obligations and resolve any disputes that I may have;
In short

In shortTo reply, to do the work, to keep the records straight, to improve the site and now and then to tell you about something. Nothing sinister. The spreadsheet is very boring. Spreadsheets rarely are.

How I treat personal information that is also sensitive information

Sensitive information is a subset of personal information that is given a higher level of protection under the Australian Privacy Principles.

Sensitive information means information relating to your racial or ethnic origin, political opinions, religion, trade union or other professional associations or memberships, philosophical beliefs, sexual orientation or practices, criminal records, health information or biometric information.

In short

In shortThe law keeps a list of things that need extra care: health, beliefs, biometrics and the like. So do I, and it is the same list.

Your rights and controlling your personal information

Choice and consent: Please read this Privacy Policy carefully. By providing personal information to me, you consent to me collecting, holding, using and disclosing your personal information in accordance with this Privacy Policy. You do not have to provide personal information to me, however, if you do not, it may affect your use of this Site or the products and/or services offered on or through it.

In short

Information from third parties: If I receive personal information about you from a third party, I will protect it as set out in this Privacy Policy. If you are a third party providing personal information about somebody else, you represent and warrant that you have such person’s consent to provide the personal information to us.

In short

In shortIf someone passes me your details, they get the same care. And whoever passed them on has promised you said yes.

Restrict: You may choose to restrict the collection or use of your personal information. If you have previously agreed to me using your personal information for direct marketing purposes, you may change your mind at any time by contacting me using the details below.

In short

In shortChanged your mind about my marketing? Tell me, at any time. No hard feelings, only slightly softer ones.

Access: You may request details of the personal information that I hold about you. An administrative fee may be payable for the provision of such information. In certain circumstances, as set out in the Privacy Act 1988 (Cth), I may refuse to provide you with personal information that I hold about you.

In short

In shortAsk what I hold about you. It is probably less interesting than you hope. A small admin fee may apply, and in a few cases the Privacy Act lets me say no.

Correction: If you believe that any information I hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, please contact me using my contact form. I will take reasonable steps to correct any information found to be inaccurate, incomplete, misleading or out of date.

In short

In shortIf I have got something about you wrong or out of date, tell me. I would rather be corrected than confidently wrong.

Complaints: If you believe that I have breached the Australian Privacy Principles and wish to make a complaint, please contact me using my contact form and provide me with full details of the alleged breach. I will promptly investigate your complaint and respond to you, in writing, setting out the outcome of my investigation and the steps I will take to deal with your complaint.

In short

In shortThink I have broken the privacy rules? Tell me. I will investigate myself, which is awkward for everyone, and reply in writing.

Unsubscribe: To unsubscribe from my e-mail database or opt-out of communications (including marketing communications), please contact me using my contact form or opt-out using the opt-out facilities provided in the communication.

In short

In shortOne message, or the link at the bottom of the email, and you are off the list. I will only cry a little, and not on the keyboard.

Storage and security

I am committed to ensuring that the personal information I collect is secure. In order to prevent unauthorised access or disclosure, I have put in place suitable physical, electronic and managerial procedures to safeguard and secure the personal information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.

I cannot guarantee the security of any information that is transmitted to or by me over the Internet. The transmission and exchange of information is carried out at your own risk. Although I take measures to safeguard against unauthorised disclosures of information, I cannot assure you that the personal information I collect will not be disclosed in a manner that is inconsistent with this Privacy Policy.

In short

In shortI keep it properly locked up. But nobody honest promises that the internet is safe, and I am not starting now, even for you.

Cookies and web beacons

I may use cookies on my Site from time to time. Cookies are text files placed in your computer’s browser to store your preferences. Cookies, by themselves, do not tell me your email address or other personally identifiable information.

However, they do allow third parties, such as Google and Facebook, to cause my advertisements to appear on your social media and online media feeds as part of my retargeting campaigns. If and when you choose to provide my Site with personal information, this information may be linked to the data stored in the cookie.

I may use web beacons on my Site from time to time. Web beacons (also known as Clear GIFs) are small pieces of code placed on a web page to monitor the visitor’s behaviour and collect data about the visitor’s viewing of a web page. For example, web beacons can be used to count the users who visit a web page or to deliver a cookie to the browser of a visitor viewing that page.

In short

In shortThe tracking kind of cookie, not the kind you dunk in tea. They can help my ads find you elsewhere, like a polite but persistent pigeon. Web beacons are the pigeon's smaller, quieter cousin.

Use of Artificial Intelligence and Machine Learning technologies

In the course of providing my services, I may employ Artificial Intelligence (AI) and Machine Learning (ML) technologies to transcribe phone calls, video calls, recorded meetings and sessions, as well as to process written communications like emails and messages via platforms such as Slack, Microsoft Teams, and Discord. This list is not exhaustive, and the technology may be applied to other platforms and forms of communication. These technologies are designed to improve the accuracy and efficiency of my communications and to enhance the services I provide.

The AI and ML services process both audio and written data to convert it into a text format, which may then be stored, analyzed, and used for various operational needs, such as quality assurance, training, and compliance with legal obligations. By participating in phone calls, video calls, recorded meetings and sessions, and by using written communication platforms with me, you consent to the use of AI and ML technologies for these purposes.

I am committed to maintaining high standards of data protection and privacy in the use of these technologies. Any transcriptions or processed data created through AI and ML will be treated with the same level of security and confidentiality as outlined elsewhere in this Privacy Policy. I manage the data transmitted in the course of using these technologies in accordance with the Australian Privacy Act, and I will ensure that extraterritorial requirements imposed by the GDPR are met as required.

I adhere to all applicable laws and regulations concerning the use of AI and ML in data processing. You have the right to request that your data not be subject to data processing using ML and AI for any technologies that I explicitly use for the aforementioned purposes.

These commitments are limited to the technologies explicitly used by me where your data may be subject to ML and AI processing, and for which the processing of such data is controllable by me, excluding instances where you have signed a service agreement with a vendor to allow such collection (such as when using your own account where you can manage your own privacy preferences).

If you have any concerns or questions regarding my use of AI and ML technologies, please contact me using my contact form.

In short

In shortI may use AI to transcribe our calls and messages, so I am listening instead of scribbling. You can ask me not to, and I will go back to slightly worse handwriting.

My Site may contain links to other websites. I do not have any control over those websites and I am not responsible for the protection and privacy of any personal information which you provide whilst visiting those websites. Those websites are not governed by this Privacy Policy.

In short

Amendments

I may, at any time and at my discretion, vary this Privacy Policy by publishing the amended Privacy Policy on my Site. I recommend you check my Site regularly to ensure you are aware of my current Privacy Policy.

In short

In shortIf this changes, the new version lands here. There will be no fanfare. There is no budget for fanfare.
